Terms of Service

These Terms of Service (the “Terms”) govern the purchase and use of digital photographs (“Images”) sold by the Photographer (“we”, “us”, or “our”). By purchasing any Image, you (“you” or the “Customer”) agree to be bound by these Terms.

1. Scope of Service

We provide high-resolution digital photographs taken at car meets for personal, non-commercial use only. All Images are sold as digital downloads. Purchasing an Image grants you a licence to use it in accordance with these Terms. You do not acquire ownership or copyright in any Image.

2. Licence Grant

Upon successful payment, we grant you a limited, non-exclusive, non-transferable, revocable and perpetual personal licence to download and use the purchased Image(s) solely for personal, non-commercial purposes, subject to the restrictions set out in these Terms.

3. Permitted Uses

You may:

  • Use the Image as wallpaper or screensaver on your personal electronic devices;

  • Print one single copy for personal, non-commercial display in your private residence, garage or office;

  • Share the Image on your personal social media accounts, provided you give clear credit to the Photographer (e.g. “Photo by [Your Name/Handle]”).

4. Ownership and Copyright

All copyright and intellectual property rights in the Images remain exclusively with us. Copyright is protected under the Copyright, Designs and Patents Act 1988 (as amended). This sale does not transfer any copyright or ownership rights to you. You acquire no proprietary interest in the Images.

5. Prohibited Uses

You must not:

  • Sell, resell, distribute, sublicense, rent, lease or otherwise transfer the Image or any copies;

  • Use the Image for any commercial purpose, including advertising, marketing, merchandise, prints for resale, or any revenue-generating activity;

  • Modify, alter, edit or create derivative works from the Image except for minor personal adjustments (such as cropping for personal display);

  • Remove any copyright notice, watermark or attribution from the Image;

  • Assign, sublicense or transfer this licence to any third party.

6. Delivery

After payment is confirmed, you will receive a download link for the Image(s). All sales are final. No refunds will be issued once the file has been downloaded or accessed.

7. Termination

We may terminate this licence immediately if you breach any provision of these Terms. Upon termination, you must immediately cease all use of the Image and delete or destroy all copies in your possession.

8. Enforcement

Any unauthorised use of the Images constitutes copyright infringement under UK law and may result in legal action, including claims for damages, injunctions and recovery of legal costs.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.

10. General

These Terms constitute the entire agreement between you and us regarding the purchase and use of the Images. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain in full force. We reserve the right to update these Terms from time to time.

By purchasing and downloading any Image, you confirm that you have read, understood, and agree to these Terms of Service.
